Terms of Service

1. The service

BookInSync provides booking and scheduling software for businesses (each, a “Business”), including an admin dashboard and a customer-facing booking page. We provide the software; we are not a party to the bookings, classes, payments, or other transactions that take place between a Business and its customers.

2. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract to create an account.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account, including the actions of staff you grant access to.
• Notify us promptly of any unauthorised use of your account.

3. Free trial, subscription, and fees

• We may offer a free trial (for example, 30 days). The trial’s features and duration are as described at sign-up and may change.
• After any free trial, continued use requires a paid subscription at the then-current fees.
• Unless stated otherwise, fees are exclusive of applicable taxes (such as GST), which you are responsible for.
• Fees are billed in advance for the subscription period and, except where required by law, are non-refundable for partial periods.
• We may change fees on reasonable prior notice; changes take effect at your next renewal.

4. Your responsibilities as a Business

If you use BookInSync to run a Business, you are solely responsible for:

• The slots, prices, packages, policies, and content you publish on your booking page.
• Fulfilling bookings, and for any cancellations, refunds, credits, or disputes with your customers.
• Collecting and reconciling payments from your customers (for example, cash or UPI). BookInSync only records the amounts you enter; it does not collect those payments on your behalf.
• Obtaining any consents and providing any notices required to collect and process your customers’ personal data through the service, and for complying with applicable laws (including consumer-protection and data-protection laws).

5. End users (customers who book)

If you book a slot through a Business’s booking page, your booking is an arrangement between you and that Business. The Business sets its own prices, availability, and cancellation and refund policies. BookInSync is not responsible for the services a Business provides or fails to provide.

6. Acceptable use

You agree not to:

• Use the service for any unlawful, fraudulent, or harmful purpose.
• Upload content that infringes others’ rights or violates any law.
• Attempt to access accounts or data that are not yours, or probe, scan, or breach security measures.
• Interfere with or disrupt the service, or impose an unreasonable load on our infrastructure.
• Reverse engineer, copy, resell, or create derivative works from the service except as permitted by law.
• Send unsolicited or unlawful messages using the service.

7. Data and privacy

Our handling of personal data is described in our Privacy Policy. For a Business’s customer data, the Business is the data controller and BookInSync acts as a processor on the Business’s instructions. You are responsible for ensuring you have the rights and consents needed for us to process that data on your behalf.

8. Intellectual property

BookInSync and its software, design, and branding are owned by us and our licensors and are protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You retain ownership of the content and data you submit, and you grant us the rights necessary to host and process it to provide the service.

9. Availability and changes

We work to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. The service is provided on an “as is” and “as available” basis without warranties of any kind, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, BookInSync and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the service will not exceed the amount you paid us for the service in the three (3) months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold harmless BookInSync and its operators from any claims, damages, liabilities, and expenses arising out of your use of the service, your content, your dealings with your customers, or your breach of these Terms or of applicable law.

12. Suspension and termination

• You may stop using the service and close your account at any time.
• We may suspend or terminate access if you breach these Terms, fail to pay fees, or use the service in a way that risks harm to others or to the service.
• On termination, your right to use the service ends. We will make your data available for export for a reasonable period where feasible, after which it may be deleted as described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, take reasonable steps to notify account holders. Continued use after an update means you accept the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at Trivandrum, Kerala, India will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the service.
